Terms & Conditions

Monte Lupo Online store is owned and operated by Multicap (ACN: 084 424 493). By accessing, browsing or using the Monte Lupo online store, you agree to the terms, conditions and disclaimers herein as amended from time to time.

By purchasing an item advertised on this online store and/or becoming a member of Monte Lupo’s newsletter, you agree to these Terms and Conditions. Monte Lupo may amend these Terms and Conditions from time to time and any amendment will become effective immediately. Your continued use of the online store after amendment constitutes an agreement to abide by and be bound by those amended Terms and Conditions.

Trademarks, Copyrights and Restrictions

All material on this site, including, but not limited to images, logos and illustrations, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by Monte Lupo and its related companies. The content of the online store is provided for your personal, non-commercial use. Such material may not be copied, republished, reproduced, uploaded, modified, transmitted, posted, or distributed in any way without the consent of Monte Lupo

The use of this website and these conditions is in accordance with the laws of Australia. Any legal action arising out of its use shall be brought and enforced under Australian laws. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia

GST (Goods & Services Tax)

Our products and services attract a Goods and Services Tax (GST) of 10%. All prices advertised are inclusive of GST.

Currency

All prices on the Monte Lupo online store are listed in Australian dollars (AUD).

Fraud

Any party engaged in illegal activities involving the use of our website will be subject to Australian civil and criminal sanctions and prosecution. Monte Lupo/Multicap does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website. It is an illegal violation to place orders under a false name, with a fraudulently obtained credit card or without the consent of the cardholder. All persons found to have placed a fraudulent order will be prosecuted.

Substitutions

Substitutions will not automatically be made for items that are out of stock at the time of order but you will be contacted to discuss possible substitutions.

Returns and Refunds

Returns 

In the unlikely event that your product is damaged in transit, please contact us within 2 weeks and we will automatically replace it with an item of equal value and as close to the original as possible. Please return the item to:

Refunds

We will not refund items where the purchaser has changed their mind however they may select another item/s to equal or lesser  value.

Special Orders/Commissions:  When placing an order or commission the purchaser agrees that the artwork is handmade to the specifications as outlined by the purchaser. They agree to pay 50% deposit at the time of placing the order and agree to pay the full amount on completion of the order.  Special orders/commission items are non-refundable.

Open Minds Australia Limited supports people living with mental illness and psychosocial disability. Open Minds works to enhance mental health and wellbeing by delivering a range of services focused on the individual needs of each person. Open Minds is and NDIS provider and a lead agent for various programs across Queensland and New South Wales, including headspace, Head to Health, Housing & Support Initiative (HASI), Community Living Support (CLS), Coastal Supports, Clinical Care Co-ordination, The Way Back, Community Re-Entry Services (CREST) and Youth Bloom.

We have obligations as to how we collect, hold, use and disclose personal under the Privacy Act 1988 (Cth) (the Act) and the Australian Privacy Principles (APPs).
How do we collect your personal information?

We collect your personal information:

  • from you when you provide your personal information to us, including through face to face meetings, over the telephone, by completing forms, agreements, surveys, applications, whether online, in person, in writing or over the telephone;
  • from a member of your family, next of kin, guardian or authorised representative where we are unable to collect information from you;
  • from an order of an Australian court or tribunal that authorises us to be provided with the information;

Credit card information that you provide to us by telephone or online is not kept on file. You will need to provide us with your credit card information each and every time you purchase our goods and services.

We collect your personal information so that we can provide you with the highest quality disability and mental health support services and support coordination services.
For prospective employees, consultants, contractors and suppliers, we collect your personal information to assess your suitability to work with us.

We also collect your personal information to conduct our business, to provide and market our goods and services or to enable you to attend our events and conferences.
What happens if you don’t give us your personal information?

If you do not provide us with your personal information, we may not be able to provide you with our goods or services or to engage or employ you.

Who we give your personal information to.

We may disclose your personal information to others where we are required or authorised by law or where you have provided consent for us to do so.

We may also disclose your personal information:

  • to our related entities
  • to consultants and suppliers working with us in providing professional, business, technology and corporate services

Security Policy

We take all reasonable steps to keep secure any information which we hold about you. Personal information may be stored both electronically on our computer system, and in hard-copy form.

We do not store credit card information, we securely submit credit card information to our bank for processing.
